8. The said Certificate or other due recognition shall be a recognition of the Vendors' full and complete right and title to and ownership of the said premises including all foreshore and marine rights and shall not be limited or curtailed in any manner different to other full and complete recognitions of titles to lands situate in any part of the said Colony of Hongkong commonly known and described as the New Territories.
9. In the event of the Vendors being unable to obtain such Certificate or recognition as aforesaid within one year from the date hereof this agreement shall be null and void.
10. The costs of this agreement shall be borne by the said parties equally.

This Indenture,
made the Third day of September One thousand nine hundred and two BETWEEN LAM CHUNG Fex alias LAM SING NAM and LAM TAK Lux alias LAM YEE YEEN both of Chik Mi village in the District of Sun On in the Province of Kwong Tung in the Empire of China Traders (who and each of whom and whose and each of whose heirs executors and administrators are where not inapplicable hereinafter included under the designation "the Vendors") of the one part and TIN PAT HING of Victoria in the Colony of Hongkong Contractor and Lau Saxo of Yaumati in the said Colony Trader (who and each of whom and whose and each of whose heirs executors administrators and assigns are where not inapplicable hereinafter included under the designation "the Purchasers") of the other part WHEREAS by a deed in the Chinese language dated the second day of the twelfth moon of the Eighth year of Kwang Hsu (the thirtieth day of December One thousand eight hundred and eighty-three) and made between CHIM YEE and KING SUI and the elders of ancestor Lam Kwai Fong of the one part and the Vendors of the other part for the consideration therein mentioned ALL that lot of seabeach situate at Kowloon City in front of Kim Fu Yamen extending Eastward to the front of Ngau Shi Wan and Westward to the English boundary line became vested in the Vendors their executors administrators and assigns absolutely AND WHEREAS all the said premises are now vested in the Vendors who have agreed with the Purchasers for the sale thereof to them for the price of Nine thousand Dollars NOW THIS INDENTURE WITNESSETH that in pursuance of such agreement and in consideration of the sum of NINE THOUSAND DOLLARS now paid by the Purchasers to the Vendors (the receipt whereof the Vendors do and each of them doth hereby acknowledge) They the Vendors DO and each of them DOTH hereby assign unto the Purchasers ALL that lot of seabeach situate at Kowloon City in front of the Kim Fu Yamen extending Eastward to the front of Ngan Shi Wan and Westward to the English boundary line containing in the whole 40.59 acres of land being Claim U No. I Survey District and Claim K No. II Survey District Serial No. 2363 AND all rights privileges easements and appurtenances thereto belonging AND all the estate right title interest property claim and demand of the Vendors therein and thereto TO HOLD the said premises unto the Purchasers as tenants in Common absolutely Subject to the payment of the rents and to the performance of the covenants to be reserved and contained in respect of the hereby assigned premises AND the Vendors hereby covenant with the Purchasers that notwithstanding any act deed or thing by the Vendors done or knowingly omitted or suffered they the Vendors now have good right to assign the said premises as aforesaid free from incumbrances AND that they the Vendors and all persons claiming under or in trust for them shall at all times hereafter at the request and cost of the Purchasers do all acts and execute and sign all deeds and writings reasonably required for perfecting this Assignment AND the Purchasers hereby covenant with the Vendors that they the Purchasers will pay the rent and perform the covenants to
